Thomas was a "Schoolmaster" while a resident of Essex County, Va. in 1693, Simon Miller deeded him land: Deed Book 2, page 2 "Simon Miller, planter of Essex County, Parish of St. Mary's to Thomas Park, Schoolmaster of Essex County, Simon Miller gives Thomas Parks a lifetime use of as much land as he can use in Richmond County, Virginia. Simon Miller applied the law of Escheat to this gift, which the land would return to the Miller Estate at Thomas Parks death. Date of deed January 14th, 1692/3 ... Sarah Miller was the daughter of Simon Miller.He was a "Schoolmaster" while a resident of Essex County, in 1693.In 1693 Simon Miller deeded land to Thomas Parks as a gift-lifetime for his service in Richmond County, Virginia.After Thomas' death possession reverted back to Simon Miller or heirs.1,6,5 |

John Withers

JOHN WITHERS and his wife and his younger brother, William Withers, came to Stafford County, Virginia, sometime in the late summer of 1655. They were the sons of William Withers, yeoman, of Arkholme, Melling, County of Lancaster, England. From the history given in Part I of the Withers family of Lancashire, England, we know that they left in their English home their father, mother, two brothers, and a sister, with whom they kept up communication which has been shown in records later in Virginia. When they came to Virginia, Stafford County as a separate Court had not been organized, but the area comprised in that county up until 1664 was in Westmoreland County. The Land Books show that John Withers took up one hundred and fifty acres of land on Potomac Creek for the transportation of three persons into the Colony, September 4th, 1655 (Book I, p. 113, recorded in Westmoreland County, Virginia). John Withers was just 21 years of age and newly married when he came to Virginia. His brother William was not quite of age. Fifty acres was the headright given to each settler and the persons whom he brought into the colony. This 150 acres was their first home in America. Later these two young immigrants took up more land along Potomac Creek, where we find them on adjoining tracts of land. They died within a year of each Other and both left wills which were recorded in books that were destroyed in some one of the events which overtook the old Court House of Stafford County, Virginia. It happens that the old general index for these books is extant. Fortunately for us, later instruments, that were preserved, give bits of information about their wills and other details. It is tantalizing not to have the full records but better to have these scraps than nothing at all.
The court and land records unfold the story of the beginning of the Withers family when their new home was still under the jurisdiction of Westmoreland County, then after 1664 transfers this to the newly formed Court of Stafford County. The first item of importance is found in Westmoreland County, Virginia.
Book (1653-1659) opp. p. 39. Mr. Fowkes discharge to John Withers; know all men by these presents, I, Gerrard Fowkes, Merchant of Westmoreland County on Potomac River in consideration of going on a voyage to Virginia on a visit in my Shallop do quit claim and release to John Withers of all accounts, damages, demands, leases whatsoever to this day, December 19, 1654. Witnesses: Anthony Bridges, J. Bailey. This discharge was recorded July 20th, 1655 in Westmoreland County, Virginia.
The above contract which was made between Gerrard Fowkes and John Withers is most interesting. It tells that John Withers arranged for their coming to Virginia while still in England and that upon arriving in this country this instrument was recorded to show that he had paid all transportation expenses for his party of three persons. This was necessary in order to get the headrights due him. He may have accompanied Gerrard Fowkes back to Virginia in his small private ship (Shallop) or he may have taken passage on a separate vessel.
The interesting part of this is that John Withers negotiated for his coming to Virginia and settling on land adjoining Gerrard Fowkes' land before he came to his new home. The recording of this contract and the taking up of land are of the same date. This places John Withers and his brother, William, in Virginia July 20th, 1655. The patent for this first 150 acres of land is recorded in Book I, page 113, Westmoreland County, Virginia, and described as on Potomac Creek along Captain Brent's land and Barron Ridge and was recorded September 4, 1655. In the same book on page 39 is recorded, July 30th, 1655, the cattle mark given to William Withers. The cattle mark registered by William Withers was according to the prevalent custom of the early inhabitants who branded their cattle and then turned the cattle out to be gathered in later and recognized by this mark.
The land grant books for Stafford County, Virginia show that John Withers and William Withers took up land along Potomac Creek and on the branches of this creek and on Accoceek Creek adjoining each other and with the same neighbors.
From the large grants of land taken out by John Withers and the parts of these grants which were kept and held by him until his death, and the controversies which arose over the conveyance of one particular tract called Chotank, we get a great deal of information about this generation and their relations in Virginia and in England and about their associates and neighbors. The Chotank land will be taken up later.
John Withers was a man of ambition, enterprise, and leadership. William Withers, his brother, was more cautious in his adventures. The fulfillment of their ambitions and hopes in seeking homes in the new country unfolds as one follows them through the pages of the old books of Westmoreland and Stafford Counties. Placing these items in the order of their happening is the clearest way to get this story.

Capt. John Withers resigned as Burgess to become Clerk of Stafford County, Virginia, which office he held at time of his death.
Capt. John Withers was one of the three men appointed to lay out the town of Marlboro in Stafford County, November 11, 1691 which was the site of the old Court House until it burned in 1717.
In the Indian troubles which arose from the settlement of Piscataway and Accoceek Indians in the backwoods on the Virginia side of the Potomac River and their refusal to return to their abodes in Maryland, the home of Capt. John Withers on the Potomac River is mentioned.*
The will of Capt. John Withers was recorded in one of the lost will books of Stafford County, Virginia. The index to this book shows that it was admitted to probate sometime in the fall of 1699. Two of the bequests from this will came up in controversies many years afterward.
The foregoing records tell the story of the long and eventful life of Capt. John Withers in the colony of Virginia; from his public life we now turn to his family connections. We know that he had a wife named Ann in 1662, but do not know how long she lived nor how many children they had. One daughter of this union survived and married an intimate friend and a political associate of her father. She was Mary who married first, Thomas Hathaway and second Richard Fossaker who by virtue of this intermarriage was the executor of the estate of Captain John Withers in 1699/1700. That Capt. John Withers married a second time and by this intermarriage had at least one daughter, Sarah, would seem the only logical conclusion to be drawn. Not long before his death Capt. John Withers married the attractive and wealthy young widow, Frances (Townsend) Dade, who survived him and who married as her third husband Col. Rice Hooe, whose former wife had been Mary (Dade) Massey, a sister-in-law of Frances (Townsend) Dade. There were no children by this third marriage of Capt. John Withers.
